PERTH GLORY TERMS AND CONDITIONS
MEMBERSHIP 2023/24

These terms form a legally binding contract between you (the Member) and Okewood Pty Ltd (ACN 053 910 133) trading as the Perth Glory Football Club (PGFC or the Club). By purchasing a PGFC Membership, you expressly agree to be bound by and comply with these terms and all applicable laws and regulations relating to these Terms.


1. Membership Rights

PGFC reserves the right to change all or any of the package details enclosed in the 2023/24 Membership Brochure, collateral, website and accompanying application forms, including changing allocated and general admission seating. In the Club's absolute discretion, the Club reserves the right not to accept an application for Membership. PGFC reserves the right to cancel your Membership at any time if, and restrict that Member from purchasing Memberships in the future if:

a)      in the opinion of the Club, the Member engages in any unbecoming conduct which is prejudicial, or likely to be prejudicial, to the interests or reputation of the game, PGFC, Football Australia (FA), Australian Professional Leagues (APL) or any of their sponsors; or
b)      the Member breaches these Terms.

Once an application for Membership is sent to the Club, you will receive a confirmation email. Your Membership purchase is final and cannot be cancelled for any reason during the purchased season. It is a condition of sale that any Membership or Ticket must not, without prior written consent of the Club, be resold nor used for advertising, promotion or other commercial purposes (including competitions or trade promotions) or to enhance the demand for other goods and services. If a Membership or Ticket is sold or used in breach of this condition, the bearer of the Membership may be denied admission without prejudice to any other right available to the Club.   

2. Membership Terms 

2.1           By default, Memberships will be placed on the Paperless Auto-Renewal Payment Plan, which consists of 7 equal instalments with all payments equivalent to the total package price divided. The initial amount is due immediately and the remaining 6 payments will be spread equally over 6 months to be deducted on the 17th of each month. Members also have the option to make a one-off payment by submitting a request form before the cut-off, Friday, 30 June 2023. By becoming a member, you accept the terms and conditions and that your membership seat/s will automatically be renewed each season unless you choose to opt-out during relevant renewal periods to be announced by the Club. Country Memberships will automatically revert to an 'annual' payment, deducting the total amount in one instalment. Country Membership must be paid in full upfront. Families (classed as residing at the same address) may purchase up to 3 Country Memberships per season. Any additional Country Memberships purchased online will be cancelled and refunded.
2.2 PGFC Members will have a minimum of 28 days from the original notification sent by the Club to opt-out and/or request changes before Memberships are renewed. By becoming a PGFC Member, you automatically accept these terms and conditions. After this date, any seats not renewed will be released, and the Member will have no further rights concerning the seat. Seat location will be determined at the time of purchase and is not subject to change by the Member at any time. The Club may ask Members to change seats for allocation purposes. Seating remains at the discretion of the Club at all times and is subject to availability. All prices listed via the website and the Membership Brochure are inclusive of all fees and GST.
2.3 You will be entitled to the Club Membership benefits in the category applied and paid for. Club Membership does not entitle you to any other rights except as expressly set out in these Terms. Specifically, Club Membership does not entitle you to entry into Finals Series fixtures; however, you may have priority access to purchase tickets. Club Members do not have the right to attend or vote in any Club meeting or participate in any dividend entitlement of any nature whatsoever.
2.4 Members receive 10% of all merchandise purchased through the official Club Team Store, excluding sale items, gift vouchers, and personalisation.

Member's $10 Merchandise Birthday Vouchers are not redeemable for cash or transferable in any way and are ONLY redeemable at the PGFC Team Store. You will receive $10 off your purchase with any purchase over $50 at the Perth Glory team store located at 70 Parry Street Fremantle. Member Birthday Vouchers cannot be used on sale items, gift vouchers or personalisation. The Member's Birthday Voucher is valid for 1 month (30 days) from the day the email is sent. Please be aware you may be asked to provide your DOB or Member number upon redemption.
2.6 Club Membership commences on the date the Club accepts your Membership and continues until the conclusion of the relevant A-League season, provided all payments are kept up to date, and your Membership is not cancelled or terminated earlier by the Club in accordance with these Terms.
2.7 Membership cards must be presented for entry at each home-fixtured game to gain entry (excluding Deep Purple & Country). Deep Purple & Country Members require a hard copy ticket, be that paper or electronic, which will be issued to Members before the game by PGFC. PGFC require a minimum of 15 business days' notice for all ticket requests to be guaranteed.
2.8 All Members must take responsibility for updating all personal details by using their unique log-in to the Membership portal, by calling the Club on 08 9492 6000 or by emailing membership@perthglory.com.au. PGFC communicates to Members via email and holds no responsibility for Members not receiving any communications due to personal details not being updated.
2.9 Replacement of any lost, stolen, or damaged Membership cards will incur a $15.00 reprint fee per card which must be paid upfront. Once a Membership card is reported lost/ stolen, the card will immediately be cancelled, with barcodes becoming inactive. Should the replacement card not be available for the next home game, you can visit the Membership desk, to be issued as a lost ticket voucher. The Membership desk is located at Gate 1 at HBF Park on match day. Photo ID will be required when collecting from the Membership desk.
2.10 Children under 3 at the time of purchase are admitted free, permitted they do not occupy a seat of their own and sit on an adult's lap.
2.11 To qualify for a Junior Membership, the child must be 16 years old or younger at the time of purchasing the Membership.
2.12 A Family Membership consists of 2 x adults and 2 x children or 1 x adult and 3 x children. Children must be 16 years or younger at the time of purchase. Additional junior Members can be added to each Family Membership at a reduced rate when purchased in the one transaction with a Family Membership by contacting the Membership Team directly. Children under 3 at the time of purchase are admitted free if they sit on an adult's lap. If a seat is required, you will need to pay the applicable junior rate.
2.13 Concession Membership applies to Australian Aged Pension, Seniors Card, and Disability Pension card (carer is admitted free of charge with valid proof of companion card in conjunction with a purchased concession Membership). PGFC accepts the Companion card and Full-time Tertiary students with Student ID. Proof of eligibility for child and concession Membership MUST be available for display on entry into the venue and at the point of sale.
2.14 Members wishing to sit within an organised active supporter group must purchase a Shed Membership, which is situated in the dedicated area. For those under 18, we recommend purchasing a Silver membership, enabling you to sit in the North blocks of HBF Park closest to the Shed.
2.15 PGFC season Memberships do not include entry to Football Australia's Alternate Market Match' fixture or Australia Cup fixture, even if the game is in Perth.
2.16 Membership cards are transferable and will allow entry to patrons regardless of the printed name on the card. However, each Ticket will only permit one (1) entry per Match. Adults and concession holders may not enter on a child's Membership card, and adults may not enter on a concession Membership card. Members may visit a Ticketmaster Ticket Box on Match Day to pay the difference and upgrade to the correct category.
2.17 
If any instalment is not paid on schedule, you hereby consent to PGFC reprocessing any outstanding instalments within 7 days of the initially rejected instalment without notification to the Member. At the discretion of PGFC, if an instalment payment is missed, you will be charged additional instalments at the next scheduled payment date to catch up on your payments, and a $10 fee will be charged for any failed payments. PGFC reserves the right to cancel the Membership without notice to the Member due to non-payment, with all rights forfeited by the Member and no refund given for any payments made. If your credit card details change, it is your responsibility to inform the Membership Team via (08) 9492 6000 or update your card details via the online portal and email us for notification.
2.18 Membership loyalty is based on consecutive years of Membership only. Should you miss a year of memberships, your tenure restarts as a first-year Member.

3. PGFC "Paperless Auto-Renewal" (PA-R) Terms and Conditions

3.1          By default, Memberships will be placed on the Paperless Auto-Renewal Payment Plan, which consists of 7 equal instalments with all payments equivalent to the total package price. The initial amount is due immediately and the remaining 6 payments will be spread equally over 6 months to be deduced on the 17th of each month. The PGFC PA-R conveniently auto-renews Members Memberships from year to year. PA-R will, by default, begin on the 6-month instalment plan unless otherwise elected during the 28-day renewal period as specified by the Club. PA-R can only be used with a valid MasterCard or Visa. Payment plans are not available via EFTPOS cards, including savings and chequing accounts.
3.2 You acknowledge that membership fees may increase from season to season. PGFC will provide reasonable prior notice of any changes to Membership fees.
3.3 You will have 28 days from the date of the Club's notice to advise the Club of any changes or upgrades you wish to make to your membership package or to notify PGFC in writing if you do not wish to roll over your Membership into the next season. The Club will also send a reminder before the PA-R rollover. Strict timeframes apply. If you do not notify the Club that you do not wish to roll over your Membership during this period, you will be taken to have agreed to your Membership being rolled over. Members can opt out of the automatic renewal by submitting the appropriate form during the renewal window.
3.4 If you wish to change your nominated credit or debit card from which payments are deducted at any time, you will need to contact Membership Services on 08 9492 6000. Each Member is responsible for ensuring that: (a) the credit card details you have provided are correct, including notification should the expiry date change within the program; (b) you have sufficient clear funds available in the nominated account on the scheduled drawing date.
3.5 Any junior or concession member who no longer meets age restrictions will automatically be upgraded to the correct membership level. This information will be outlined in the renewal rollover communication. This also applies to junior members that are part of family memberships.
3.6 You must ensure that:

1.     The credit card details you have provided are correct, and notify PGFC immediately should the expiry date change within the 6-month plan;
2.    You have sufficient clear funds on your nominated MasterCard or Visa credit or debit card on the scheduled instalment date.

3.7 Any person who holds a concession membership (including as a claim of concession status resulting from an upgrade in accordance with paragraph 5) must provide proof of concession. Your concession card must be valid for the whole season. New concession details are to be provided at the time of purchase and again when the card expires. Failure to do so may result in your application automatically being processed as an adult membership or refusal of entry at the gates.
3.8 If your payment is returned or dishonoured by your financial institution, PGFC will contact you to request immediate payment. Any fees levied to you by your financial institution will be payable by you.
3.9 PGFC may action the following on your Membership if your drawing is dishonoured by your financial institution:

1.      A $10 failed instalment fee will be charged on all failed instalments.
2.    Your Membership card will be suspended if any payments are outstanding before game day.
3.    If your payment defaults on four (4) consecutive occasions, your Membership will be suspended, and your seat may be released for sale for the next Match.
4.   If your payment defaults on five (5) consecutive occasions, your Membership will be cancelled

3.10       Your Membership may, at the discretion of PGFC, be reinstated upon payment of the overdue amount. Where a payment appears in arrears by more than 90 days, the Club reserves the right to cancel your Membership
3.11 Members with outstanding debt will be unable to renew their Membership until all outstanding money owed is paid
3.12 Members use the PA-R program at their own risk entirely, and PGFC accepts no liability for any matter arising from your use of the program.
3.13 If you believe a withdrawal has been initiated incorrectly, please contact PGFC Membership Services via 08 9492 6000.

Monthly PA-R, NEW Members

Direct monthly payments will be deducted in 7 equal instalments, with all payments equivalent to the total package price.
The total package price is divided by 7, with the initial amount due immediately and the remaining 6 payments to be spread equally over 6 months.
The 1st payment of your instalment will be deducted upon receipt of your application and then monthly on the 17th of every month via a nominated VISA or MasterCard only. There is a $1 administration fee for every scheduled payment, the maximum amount being $6 per transaction. i.e. for those purchasing multiple Memberships, you will only be charged one fee provided the Memberships are part of the one transaction.

Payment Periods are from the date of purchase through to 17 January 2024. Instalment due dates will fall on the 17th of each month. 

Any purchases made after 31-Oct-23 will have an initial catch-up payment to bring monthly instalments up-to-date. The catch-up payment will vary depending on the month the membership purchase is made. Monthly instalments will then commence on the 17th day of each month, concluding January 2024.

4. Cancellation, Fees and Exchanges

Due to the operational needs of the Club, the Club may be required to act on short notice (including, but not limited to, when there is a late change of match days, venue or a Force Majeure Event, including Covid-19) and the Club will have the right, at its sole discretion, to: change all or any of the package details, name, pricing, benefits, inclusions, venue, admission conditions, ticket inclusions or scheduling, including changing allocated and general admission seating areas at any time. The Club will use its reasonable endeavours to provide compensation options to the value of the original benefit.

4.1 Once your Membership application is submitted to the Club, you cannot cancel your Membership.
4.2 Dishonoured credit card payments: if your bank declines a credit card payment, you will be contacted regarding an alternate form of payment. If the further payment option is unsuccessful, your order will be removed from the seating allocation queue.
4.3 The Club's use of HBF Park is subject to the terms of the venue agreement between the Club and HBF Park. The Club's A-League home games have been scheduled to minimise the prospect of Matches being cancelled; however, you acknowledge that all Matches are subject to cancellation or rescheduling to another venue, time or date for any reason.
4.4 If a Match is cancelled, rescheduled to a venue outside of the Perth Metropolitan area or played without a crowd in attendance, the Club may offer other reasonable compensation, taking into account the totality of the Member Benefits. Any exchange entitlement must be applied for in accordance with instructions and time frames issued by the Club from time to time.
4.5 Subject to your Consumer Rights, you cannot obtain a refund or exchange your Ticket if: (a) the date or time of, or teams participating in, a Match changes after the date you purchased your Ticket; (b) the Match is rescheduled to another venue in Perth; or (c) after a Match has started it is cancelled for any reason.
4.6 Subject to the Competition and Consumer Act:

1.     the Club is not liable to you for any loss or damage you suffer as a result of the A-League or any Match being cancelled, postponed or changed; 
2.    the Club disclaims the existence of any common law duty of care to you and any holder of the Ticket.

4.7 The Club will not replace your Ticket if lost, stolen, forgotten, damaged, forged or unreadable.
4.8 You will bear the prevailing replacement fee(s) for replacing a lost, stolen or damaged Ticket.
4.9 The Club reserves the right to cancel a Membership at any time if, in the opinion of the Club, a Member engages in Disruptive Behaviour.
4.10 The Club reserves the right to immediately cancel or suspend a Membership at any time if, in the opinion of the Club, a Member engages in the misuse of their season ticket/Membership card.
4.11 PGFC reserves the right to cancel the Membership in accordance with these Terms, with all rights forfeited by the Member with no refund given for any payments made.
4.12 Members outside of Australia will need to pay additional postage charges for the members' pack if they are unable to provide an Australian address. The country of the postal address determines the postage charge.
4.13 An additional $1.00 Administration Fee will be charged on each instalment via the PA-R
4.14 Should the club agree to provide a refund, an administration fee of $30 per Membership will be retained to cover fulfilment costs, assuming the Membership has already been supplied or produced. 

5. Payment Methods

The Club accepts payment of Membership in the following capacities:

1.     Cash or Eftpos (in-person transactions only)
2.    Credit or Debit Card (Mastercard or Visa only)
3.    Cheques will be accepted only when necessary
4.   Please note: The Club charges for Membership in Australian Dollars and is not responsible for any loss caused as a result of the use of foreign currency.

6. Ticket Conditions

In respect of all Ticket/s you receive as part of your season ticket or Club Membership, you must comply and must ensure that each subsequent holder of any of your Tickets complies with (a) these Terms; (b) the ticketing conditions as set out on the back of the Tickets; and (c) the rules and regulations of HBF Park, including terms of entry and any restricted or prohibited items.

You must comply with FA's Terms of Admission (available on www.footballaustralia.com.au). You must not enter the playing enclosure of a venue at any time, and if you do, you may be fined, expelled from the venue or banned from attending further Matches and subject to legal action. If you are expelled from the venue, you will not be entitled to a refund on any part of your Membership.

8. Limitation of liability

Nothing in this clause affects your rights under the Competition and Consumer Act or similar legislation under which the Club's liability may not be excluded, restricted or modified by private agreement.

If the Club is liable to you for any: (a) breach by the Club of any express term of these Terms; (b) breach by the Club of any term implied into these Terms under the general law; or (c) any tort committed by the Club (including negligence but not including fraud), the Club's liability to you is limited (at the Club's election) to the Club repaying any amounts paid by you under these Terms or supplying or resupplying any Tickets to which you are entitled in accordance with these Terms.

Subject to your Consumer Rights, (a) the Club is not liable to you for any loss or damage you suffer as a result of the A-League or any Match being cancelled, postponed or changed; and (b) the Club disclaims the existence of any common law duty of care to you and any holder of the Ticket.

The Club is not liable for any failure to perform its obligations pursuant to these Terms if such failure is due to a Force Majeure Event (including Covid- 19).  If a failure by the Club to perform its obligations is caused or anticipated due to a Force Majeure Event, the Club's performance of its obligations will be suspended.

9. General

The Club may choose, in its absolute discretion, not to enforce these Terms in some cases without affecting its right to enforce them in other cases.

These Terms are governed by the law applicable to Western Australia, and each party submits to the jurisdiction of the Western Australian Courts.

These Terms are the entire agreement between PGFC and you in respect of its subject matter and supersedes any prior agreement, representation or promotional material.

10. Definitions

In these Terms:

A-League is known as the national club competition staged by APL( Australian Professional Leagues) known as the A-League (or a name as otherwise notified by APL).

Consumer Rights means any rights of a Member pursuant to the Competition and Consumer Act or similar applicable legislation;

FA means Football Australia Limited, which is the national governing body of Football in Australia.

Force Majeure Event means any circumstance beyond the reasonable control of the Club's control which results in the Club being unable to observe or perform an obligation under these Terms.  Such circumstances include but are not limited to:

(a)           acts of God, lightning strikes, earthquakes, floods, storms, explosions, fires, pandemics (Covid-19) and any natural disaster;
(b)           acts of war, acts of public enemies, terrorism, riots, civil commotion, malicious damage, sabotage and revolution;
(c)           industrial strikes; and
(d)           specific weather events adversely affecting or likely to adversely affect the provision of the Services;

Match means a match in the A-League in which PGFC participates in at the date, time and venue and against the opposing team as specified on www.footballaustralia.com.au from time to time, but excludes the Finals Series, FFA Cup and any other match, competition or tournament staged or sanctioned by FFA.

Member Benefits mean PGFC Members-only newsletters, PGFC plastic Members card, access to Members' events, priority rights to purchase tickets to any finals series match at HBF Park.

ORDERING

Customer may order the products and services from Sport Subs by completing and submitting the order form on our website. In placing an order, Customer agrees to be bound by these Terms and Conditions.

How to buy:

  • Place your order on our website;
  • Print or save your receipt order for your records;
  • You will receive an automated confirmation email from Sport Subs. Please do not reply, it is an automated response to your order;
  • Please make a payment according to the amount quoted in the invoice. The goods ordered from Sport Subs must be prepaid and funds are cleared before we despatch the products.

PRICING INFORMATION

All goods and services attract the Australian Federal Government Goods and Services Tax (GST) of 10%. The prices shown for products include postage and handling and GST, and the total GST paid is shown in the Tax Invoice. All monetary values shown on this site are Australian Dollars (AUD). REFUND POLICY:

No refunds will be provided, unless specified by Fair Trading Legislation. Refunds must be claimed within 7 days from the date of purchase. All products refunded must be in original condition including packaging. Any products returned may incur up to a 20 % restocking fee. All cost incurred in returning the product to Sport Subs for repair, replacement or credit are the customer’s responsibility.

  • Customer must notify us and obtain RA (return authorisation) before any products are returned.
  • A copy of original invoice must be sent with the goods.
  • An RA doesn’t guarantee credit, repair or replacement. It is just an authorisation to return products to us.
  • Please check the specifications and compatibility of the products being ordered to ensure they are what you want as we do not sell goods on a trial basis.
  • We do not refund or credit for incorrect purchase.
  • No credit is available for any freight paid.
  • RA is valid for 7 days only.
  • If you receive a product that appears to have been ‘Damaged in transit”, that is damaged in transit from Sport Subs to you, you should refuse to accept delivery of the goods and notify us immediately.

If Sport Subs is warned from delivering the products because of any act of God, industrial dispute, lock-out, fire, flood, war, transport delays or any other cause beyond its control then it shall be entitled at its option to either extend the time for delivery until a reasonable period after such cause has ceased or to cancel the sale and in neither case shall the customer have any claim for loss or damage against Sport Subs.

PAYMENT OPTIONS

Payments are made by credit/debit card only. All payments are made via our “Gateway Provider”, Stripe (https://stripe.com); it is they who will contact the card issuer and request payment in real time and will either charge or reject the charge at the end of the checkout process. Should the payment be rejected the Customer will be advised as to the reason given by your card issuer for the rejection – neither Expeed nor the Gateway Provider make any determination as to your ability to make payment or financial worthiness, save for required fraud-checking and all charge results that are shown are that as determined by the card issuer

When making payment, the Customer will either pay for the product in full, or elect (in some, but not all cases) to pay on a payment plan. When opting for a payment plan, the Customer will be advised of the payment interval dates and amounts. The indicated amount will be charged to the same card used for the initial payment on those interval dates. If the Customer becomes aware that the payment cannot be made on the specified interval date, they should contact the Club concerned to advise them and make alternative payment arrangements.

The Gateway Provider is solely responsible for storing and processing of card details, and at no point do Sport Subs, the Club or any staff of either party get to see card details in full. At no point do card details entered on the Website get transmitted through or stored on the web servers of Sport Subs or the Club. Our Gateway Provider will issue Sport Subs with an encrypted “token” to represent the card details they have stored for the Customer’s card, and it is this token that Sport Subs refer to in all communications with the Gateway Provider. Masked details of the cards that the Gateway Provider has stored for Customer will be displayed in the MyAccount section of the Website, where the Customer can manage those cards and the purpose(s) for which they are used.

CHANGES TO TERMS

Each order is bound by the terms and conditions current when the order is placed. Sport Subs may change these terms and conditions without notice. It is your responsibility to read and understand these terms and conditions each time you places an order. All purchases under this website and these terms and conditions are subject to the laws of South Australia, Australia

LIMITATION OF LIABILITY AND DELIVERING OF ORDERS

Sport Subs will in no way be liable for any direct, indirect, incidental, special or consequential damages, resulting from your use or your inability to use this website or for the cost of procurement of substitute products or services or resulting from any products or services purchased or obtained or messages received or transactions entered into through this website or resulting from unauthorised access to or alteration of your transmissions or data or of any information contained on this website, including but not limited to, damages for loss of profits, use, data or other intangible, even if Sport Subs has been advised of the possibility of such damages.

All goods and services attract the Australian Federal Government Goods and Services Tax (GST) of 10%. The prices shown for products include postage and handling and GST, and the total GST paid is shown in the Tax Invoice. All monetary values shown on this site are Australian Dollars (AUD).
